Whataburger customer seeks more than $200,000 after falling at restaurant

HOUSTON – A Whataburger patron has filed a suit after he broke his wrist in a fall at the restaurant.

Robert A. Schauer filed a complaint on Nov. 27 in the Harris County District Court against Whataburger Restaurants LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 1, he was alone in a restroom at Whataburger restaurant in Cypress when the light turned off. The suit states that while he was attempting to feel his way out in the dark, he fell, breaking his wrist and sustaining other injuries.

The plaintiff holds Whataburger Restaurants LLC responsible because the defendant allegedly failed to remedy a known defective and dangerous condition and safe to maintain a safe premises.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other relief both general and special. He is represented by Reed W. Burritt of Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston.
