Debt Recovery Solutions alleged to have violated debt collection law with voicemails

SHERMAN – A Plano consumer alleges a debt collector violated regulations when it left voicemails that did not disclose the name of the collector.

Zohaib Mohammed, individually and on behalf of all others similarly situated, filed a complaint filed a complaint on Nov. 28 in the Sherman District of the Eastern District of Texas against Debt Recovery Solutions LLC alleging that the debt collector violated the Fair Debt Collection Practices Act.

According to the complaint, the defendant began calling the plaintiff in October in an attempt to collect an alleged debt and left at least two automated voice mails that did not disclose the name of the debt collector.

The plaintiff holds Debt Recovery Solutions LLC responsible because the defendant allegedly violated the FDCPA by not disclosing the name of the debt collector in the voice mails.

The plaintiff requests a trial by jury and seeks actual and statutory damages, disgorgement of all of defendant's revenues obtained through use of said practices, attorney’s fees, costs and expenses and such other appropriate relief.
