Consumers allege LVB Automotive Inc. falsely represented Explorer was mechanically sound

HOUSTON – Two Austin County consumers allege a car dealership made false representations regarding a vehicle they purchased.

Mitchell Marcoulier and Julie Marcoulier filed a complaint on Nov. 28 in the Harris County District Court against LVB Automotive Inc. alleging that the used automobile dealer violated the Texas Deceptive Trade Practices Act and other counts.

According to the complaint, the plaintiffs allege that on June 6, 2017, Mitchell Marcoulier and Julie Marcoulier purchased a used 2004 Ford Explorer from defendant for $3,500. The suit states that the vehicle was advertised as a "daily driver" with "no mechanical problem," but after they purchased the vehicle, their mechanic told them it would cost thousands of dollars to repair the it to a mechanically sound condition.

The plaintiffs holds LVB Automotive Inc. responsible because the defendant allegedly misrepresented that the car had no mechanical issues and misrepresented that it would provide a clear title to the vehicle when it had no intention of doing so.

The plaintiffs seek actual, treble and exemplary damages, pre- and post-judgment interest, costs and such other and further relief. They are represented by Joshua D. Lee and Scott P. Armstrong of Armstrong Lee Savage LLP in Houston.
