Consumer alleges BorrowersFirst Inc. harassed him with collection calls

HOUSTON – A Harris County consumer alleges a debt collector harassed him with 50 calls a day.

Francis Michael filed a complaint on Nov. 29 in the Houston Division of the Southern District of Texas against BorrowersFirst Inc. alleging that the financial institution violated the Telephone Consumer Protection Act and the Texas Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that, in July 2017, he began receiving calls from defendant attempting to collect an alleged consumer account. He alleges on July 10, he spoke with a representative of the defendant and revoked his consent to receive calls but the calls continued. The suit also states that between July 10 and Aug. 15, the defendant called 50 times a day "to annoy and harass him in the hopes that it could induce plaintiff to pay the debt."

The plaintiff holds BorrowersFirst Inc. responsible because the defendant allegedly made calls repeatedly and multiple times a day using an automatic telephone dialing system and/or an artificial or pre-recorded voice messages in violation of the TCPA.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each and every negligent violation and $1,500 for each and every knowing and/or willful violation of the act, award for actual and statutory damages, attorneys’ fees and costs and such other appropriate relief.
