Woman sues transportation service for injury to femur sustained during ride to doctor's office

HOUSTON – What was supposed to be a ride to the doctor’s office for one Harris County woman last year has resulted in a lawsuit.

Cheryl Mendez’s suit against Your Way Medical Transportation LLC, filed on Dec. 1 in the Harris County 334th District Court, claims the company bore responsibility for an injury the plaintiff sustained to her femur while aboard one of its vehicles on Sept. 16, 2016.

The complaint states the defendant’s driver failed to properly secure the wheelchair-bound Mendez using the available safety restraints, as well as not locking the wheelchair left wheel.

“While in transit, the defendant Jane Doe braked abruptly to avoid hitting the car immediately in front of the defendants’ vehicle,” court papers say.

“The force of the abrupt stop caused the plaintiff to slide down and out of her wheelchair and onto the vehicle floor. The abrupt stop propelled the plaintiff with such force that it caused the plaintiff’s femur to break.”

The female, an unidentified female, is also a defendant in the case.

Consequently, Mendez seeks unspecified monetary damages and a jury trial.

She is represented by attorneys Jim Hart, Eloy Gaitan, and Cesar Tavares of the law firm Williams Kherkher Hart Boundas, LLP in Houston.
