Customer alleges she was injured at Beaumont CVS because of defective shopping cart

BEAUMONT – A customer at a Beaumont store alleges she was injured because of a damaged shopping cart.

Nikimba Grant filed a complaint on Nov. 22, 2017, in the Jefferson County District Court against CVS AOC Services LLC, Jimmy Avera and Tamaria Everett alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 12, 2016, she was seriously injured as a result of using a damaged and defective shopping cart at defendants' premises. She claims she sustained bodily injuries resulting in pain and suffering, mental anguish, physical impairment and loss of enjoyment of life. 

The plaintiff holds CVS AOC Services LLC, Avera and Everett responsible because the defendants allegedly failed to maintain their equipment in a reasonably safe condition and failed to remove the cart from public use.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other lawful and equitable relief. She is represented by John Pat Parsons of Lindsay, Lindsay & Parsons in Beaumont.
