GALVESTON – A Galveston County man alleges his claim for weather damages for his property was undervalued by an insurance company.
David Fannin filed a complaint on Nov. 29 in the Galveston County District Court against Allstate Vehicle and Property Insurance Co., Darrell Andre Johnson and Donnie Joe Marcantel alleging breach of contract and other counts.
According to the complaint, the plaintiff has an Allstate insurance policy to cover his property. The suit states that on Jan. 2, 2017, his property sustained extensive damage resulting from a severe storm that passed through the Friendswood area. The suit states he submitted a claim and Johnson was assigned to adjust the claim in May 2017 and Marcantel readjusted the claim in August 2017.
The plaintiff holds Allstate Vehicle and Property Insurance Co., Johnson and Marcantel responsible because defendant Allstate allegedly falsely represented that the policy included wind and hailstorm coverage for damage to plaintiff’s home and Johnson and Marcantel allegedly failed to conduct a proper inspection of the plaintiff's property, which undervalued the cost of repairs.
The plaintiff alleges the damage to his property is estimated at $41,255.44 while the defendants estimated the damages at $996.17.
The plaintiff requests a trial by jury and seeks all damages, award of attorney’s fees, costs, pre- and post-judgment interest and any other relief to which he may show himself justly entitled. He is represented by Chad T. Wilson of Chad T. Wilson Law Firm PLLC in Webster.
