Former Ultimate Pediatric Care employee alleges she was terminated after filing wage complaint

HOUSTON – A woman alleges she was terminated in retaliation for filing a complaint about unlawful overtime pay practices.

Natasha E. Miles filed a complaint on Dec. 5, 2017, in the Houston Division of the Southern District of Texas against Ultimate Pediatric Care Inc. and Mercy A. Nims alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a home health supervisor but was not exempt from the overtime provisions of the FLSA. The plaintiff alleges that between December 2016 and August 2017, she regularly worked in excess of 40 hours per week but was only compensated at her regular rate of pay for each hour worked.

The plaintiff holds Ultimate Pediatric Care Inc. and Nims responsible because the defendants allegedly never paid her time-and-a-half for all hours worked in excess of 40 hours per week as required by law and terminated her employment in retaliation in August 2017 for filing a complaint with the Department of Labor Wage & Hour Division.

The plaintiff requests a trial by jury and seeks unpaid wages, unpaid overtime, liquidated damages, attorneys’ fees, costs of court and such other and further relief. She is represented by Joshua A. Verde of The Verde Law Firm PLLC in Houston.
