Patron alleges hard object in turkey chili served by Cafe Express caused him to break crown

HOUSTON – A Houston man alleges food served to him at a shopping center's restaurant caused him to break dental work.

Herman Litt filed a complaint on Dec. 8, 2017, in the Harris County District Court against Cafe Express LLC, doing business as Cafe Express, alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Dec. 11, 2015, he was dining at Cafe Express in Meyerland Plaza. The suit states while eating turkey chili, the plaintiff felt a hard object hit his tooth, which caused him to break a crown. He alleges he accidentally swallowed the hard object. He claims he was required to have the porcelain crown replaced and at an expense of $1,470. 

The plaintiff holds Cafe Express LLC responsible because the defendant allegedly failed to ensure its food was reasonably safe and fit for human consumption.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 and such other lawful and equitable relief. He is represented by Roxell Richards of Roxell Richards Law Firm in Houston.
