HOUSTON – A Houston man has filed a lawsuit against a Katy apartment complex after his son reportedly suffered a broken arm while using one of its amenities, recent Harris County District Court records show.
In court documents filed against Dolce Living at Grand Harbor, LLC, doing business as Dolce Living Grand Harbor, LLC, on Dec. 15 in the Harris County 234th District Court, Rene Lopez claims Julian R. Lopez sustained the injury on a treadmill at the defendant’s workout facility on Feb. 29, 2016.
The elder Lopez explains that the child was using the piece of exercise equipment when an apartment employee called out to him. The young boy, whose mother purportedly lives at the complex, allegedly turned around to acknowledge the voice only to lose his balance, fall on the treadmill, and break his left arm.
“The defendant knew or should have known that having an employee distract anyone from behind while working out on the treadmill is a condition which poses an unreasonable risk of harm,” the suit says.
Consequently, the father seeks unspecified monetary damages.
He is represented by attorney Donna Roth of the law firm Roth & Associates in Houston.
