Former Project Resources Group Inc. investigator alleges he was not compensated for overtime work

HOUSTON – A former employee of a plant damage investigation and recovery services company alleges he is owed unpaid overtime compensation.

Mario Avila, individually and on behalf of all others similarly situated, filed a complaint on Dec. 13, 2017, in the Houston Division of the Southern District of Texas against Project Resources Group Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendant as a damage field investigator.

The plaintiff holds Project Resources Group Inc. responsible because the defendant allegedly misclassified him as exempt under the administrative exemption of the FLSA and failed to compensate him for all hours worked in excess of 40 hours per week at a rate of no less than one-and-one-half times his regular rate.

The plaintiff requests a trial by jury and seeks actual and liquidated damages prejudgment and post-judgment interest, costs of court, attorney's fees and any other relief to which he is entitled. He is represented by Clayton D. Craighead of The Craighead Law Firm PLLC in Houston.
