Woman claims Timothy Webb Construction failed to perform contracted work

GALVESTON – A consumer claims a Hitchcock contractor failed to perform work as contracted on a residential property.

Nan Ferguson filed a complaint on Dec. 19, 2017, in the Galveston County District Court against Timothy Webb and Timothy Webb Construction alleging that they violated the Texas Deceptive Trade Practices - Consumer Protection Act and other counts.

According to the complaint, the plaintiff alleges that on Aug. 1, 2016, she hired defendants to repair a residence at 3322 Sealy Ave., Galveston. She alleges the defendants never obtained a building permit from the city of Galveston, did not perform the work as contracted and that the property is in disrepair and is not habitable.

She alleges she suffered loss of use and diminution of value of the property, lost profits, cost of replacement and repairs and expenses for temporary housing. 

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and such other lawful and equitable relief. She is represented by Kathleen Collins of Collins & Associates in Galveston.
