Former Hudson and Marshall LLC bid coordinator alleges she is owed unpaid overtime wages

HOUSTON – A Katy woman alleges she is owed unpaid overtime wages from her former employer.

Catherine Simmons, individually and on behalf of all others similarly situated, filed a complaint on Dec. 19, 2017, in the Houston Division of the Southern District of Texas against Hudson and Marshall LLC alleging that the former employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendant from January 1998 to September 2017 as a bid coordinator and was a licensed real estate agent. She alleges that she consistently worked between 55 to 65 hours a week during the last three years of her employment with the defendant without receiving proper overtime compensation for all hours worked beyond 40 per workweek. 

The plaintiff holds Hudson and Marshall LLC responsible because the defendant allegedly classified her as exempt from the FLSA’s overtime pay requirement and did not pay her at a rate of time-and-a-half of her regular rate of pay for each hour worked over 40 each week.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, attorneys’ fees, costs, post-judgment interest and all other lawful and equitable relief. She is represented by Dennis A. Clifford of The Clifford Law Firm PLLC in Houston.
