HOUSTON – A railroad worker alleges his employer's failure to inspect and maintain equipment caused him to sustain injuries while working.
Nicholas Smoot filed a complaint on Dec. 27, 2017, in the Harris County Circuit Court against Union Pacific Railroad Co. citing the Federal Employers' Liability Act.
According to the complaint, the plaintiff alleges that on Jan. 1, 2017, he was injured while in the course and scope of his employment with defendant when the traction motor on the locomotive and train he was working suddenly exploded. He alleges he sustained injuries to his back, legs and other parts of his body.
The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to perform adequate inspections and to properly service and maintain its equipment and failed to provide warning of the defective equipment.
The plaintiff seeks damages within the jurisdictional limits of the court, post-judgment interest, costs and such other lawful and equitable relief. He is represented by Clint E. McGuire of Martinez McGuire PLLC in Houston and Arthur Sadin of Sadin Law Firm PC in Friendswood.
