Hercules Construction employee alleges he was injured because of unsafe working environment

HOUSTON – A Harris County man alleges he was injured because of the ladder his employer provided him.

Victor Ramon Reyes filed a complaint on Dec. 28, 2017, in the Harris County District Court against Fermin Garcia Jr., individually and doing business as Hercules Construction, alleging negligence.

According to the complaint, the plaintiff alleges that on July 12, 2017, he was severely injured while in the course and scope of his employment with the defendant when he was told to use a ladder that was missing a rung. 

The plaintiff holds Garcia Jr., individually and doing business as Hercules Construction, responsible because the defendant allegedly failed to provide a safe work environment.

The plaintiff seeks actual and special damages, costs of court and expenses and such other legal and equitable relief. He is represented by David K. Mestemaker, Norman Straub, Van Gardner and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
