Harris County man alleges Brookdale Galleria was negligent with wife's care

HOUSTON – A man alleges his wife developed pressure ulcers because a care facility failed to implement adequate prevention measures.

Benjamin Waserman, as next friend of Carmen Waserman, filed a complaint on Dec. 28, 2017, in the Harris County District Court against ARC Hampton Post Oak Inc., doing business as Brookdale Galleria, et al. alleging negligence.

According to the complaint, Carmen Waserman was admitted to Brookdale Galleria in January 2016 for rehabilitation after breaking her hip. She alleges that during her stay at the defendant facility, she suffered from an infected stage IV sacral ulcer and unstageable bilateral heel ulcers. The suit states she needed several months of medical treatment.

The plaintiff holds ARC Hampton Post Oak Inc., doing business Brookdale Galleria, et al. responsible because the defendants allegedly failed to implement adequate interventions to prevent pressure ulcer development and failed to provide adequate hydration and nutrition.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other and further relief. He is represented by Mary E. Green of Brown & Brothers in Houston.
