Express Courier International Inc. alleged to have misclassified couriers as contractors

HOUSTON – One hundred couriers and drivers of a corporation allege that they are owed unpaid wages and were improperly classified as independent contractors.

Carol Arroyo, Kacey Adams, Leke Adewunmi, et al. filed a complaint on Jan. 2 in the Houston Division of the Southern District of Texas against Express Courier International Inc. and EMP LSO Holding Corp. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they regularly worked more than 40 hours per week without receiving the statutory minimum wage and proper overtime compensation as required by law. 

The plaintiffs holds Express Courier International Inc. and EMP LSO Holding Corp. responsible because the defendants allegedly misclassified them as independent contractors, refused to pay all minimum and overtime wages owed and failed to reimburse their work-related vehicle expenses.

The plaintiffs request a trial by jury and seek judgment for all unpaid minimum wage and overtime compensation, liquidated damages, prejudgment interest, attorney's fees, costs and such other just and proper relief. They are represented by Josh Sanford of Sanford Law Firm PLLC in Little Rock, Arkansas.
