Harris County woman seeks damages from dentist for allegedly failing to diagnose fracture

HOUSTON – A Harris County woman alleges her pelvis fractured after a bone graft was taken from the iliac crest.

Kathy Lynn McGee filed a complaint on Jan. 4 in the Harris County District Court against John Freeman MD DDS alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 18, 2015, she underwent bone grafting surgery for a dental implant and the defendant took bone from her pelvis to graft it to her jaw. The plaintiff alleges she has osteoporosis and that the defendant was aware of this at the time of the procedure.

The plaintiff alleges that the day after the surgery, she felt a "crack" in her hip area and experienced pain. The suit states she sought treatment from an orthopedic doctor in December 2015 and was diagnosed with a fracture in her pelvis at the site of the bone graft harvest.

The plaintiff holds Freeman responsible because the defendant allegedly failed to employ proper surgical techniques when harvesting bone, failed to diagnose the fracture and failed to refer her to an appropriate medical specialist after the fracture.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of less than $1 million, pre- and post-judgment interest, court costs and such other lawful and equitable relief. She is represented by Shane R. Kadlec of Law Office of Shane R. Kadlec in Houston.
