Consumer alleges Merchants Credit Guide Co. failed to identify creditor in collection letter

SHERMAN – A Dallas consumer alleges a debt collector unlawfully failed to identify the original and current creditors of a debt in a collection letter.

Elizabeth Fichtel, also known as Elizabeth Harris, individually and on behalf of all others similarly situated filed a complaint on Jan. 5 in the Sherman District of the Eastern District of Texas against Merchants Credit Guide Co. and John Does 1-25 alleging that they violated the Fair Debt Collections Practices Act.

According to the complaint, the plaintiff alleges that on Jan. 9, 2017, she received a collection letter from defendants attempting to collect an alleged debt incurred for personal, family or household purposes.

The plaintiff holds Merchants Credit Guide Co. and John Does 1-25 responsible because the defendants allegedly failed to identify the original and current creditors of the debt in the letter in violation of the FDCPA.

The plaintiff requests a trial by jury and seeks an order declaring that the action is properly maintainable as a class action and certifying plaintiff as class representative and her counsel as class counsel, award for actual and statutory damages, costs of this action, attorneys’ fees and such other just and proper relief.
