Harris County woman accuses anesthesiologist of medical negligence

HOUSTON – A patient alleges she was injured because of the actions of an anesthesiologist.

Joanna Gustin filed a complaint on Jan. 9 in the Harris County District Court against Cora Y. Lee MD; Matthew John Byars, CRNA; et al. alleging negligence.

According to the complaint, the plaintiff presented to Memorial Hermann Katy Hospital on Dec. 20, 2015, for complaints of abdominal pain and vomiting. She had surgery the same day, the suit states, and Lee was the anesthesiologist and Byars was the nurse anesthetist.

The plaintiff holds Lee, Byars, et al. responsible because the defendants allegedly failed to decompress her stomach prior to induction of anesthesia and wrongfully placed her in a supine position despite plaintiff's statements that lying down would cause her to regurgitate. The plaintiff alleges she aspirated gastric contents during surgery, which caused other medical problems.

The plaintiff requests a trial by jury and seeks actual and exemplary damages, pre- and post-judgment interest, costs of court and such other lawful and equitable relief. She is represented by Steven R. Davis and John A. Davis Jr. of Davis & Davis Attorneys at Law in Houston.
