Consumer alleges boat purchased from The Nautic Group Inc. has defects

HOUSTON – A consumer alleges a boat he purchased from a Kemah dealer is defective.

Michael Samadi filed a complaint on Jan. 10 in the Harris County District Court against The Nautic Group Inc., Volvo Penta of the Americas LLC, et al. alleging that they violated the Deceptive Trade Practices and Consumer Protection Act.

According to the complaint, the plaintiff alleges that on April 15, 2017, he purchased a 2016 Beneteau boat from The Nautic Group Inc. He alleges he has never taken possession of the boat because he noticed several defects that needed correction during the initial voyage from the Nautic boat slip. He alleges that at least 30 items have not been repaired.

The plaintiff holds The Nautic Group Inc., Volvo Penta of the Americas LLC, et al. responsible because the defendants allegedly have refused to return the amounts paid to him and sold him a boat with defects that substantially impaired its value.

The plaintiff seeks actual, exemplary and statutory damages, pre- and post-judgment interest, attorney's fees, costs and such other and further relief. He is represented by Mark l. Aschermann of Aschermann Law in Bellaire.
