Santa Fe property owner alleges insurance agent failed to secure insurance

GALVESTON – A Galveston County resident alleges an insurance agent failed to secure her insurance before Hurricane Harvey damaged her home.

Kayla Renee Arnold filed a complaint on Jan. 11 in the Galveston County District Court against Robert Foree alleging that the insurance agent intentionally violated the Texas Insurance Code and Deceptive Trade Practices Act.

According to the complaint, the plaintiff contacted Foree to procure insurance on her Santa Fe property in August 2017. The suit states on Aug. 25, 2017, her home was damaged by Hurricane Harvey. On Aug. 30, 2017, she alleges she contacted the defendant to determine how to file the requisite insurance claims so she could rebuild her home. The suit states that the defendant told her that she did not have an active insurance policy and that her application and payment were still sitting on his desk.

The plaintiff holds Foree responsible because the defendant allegedly was negligent in his duties to secure flood insurance on her behalf.

The plaintiff requests a trial by jury and seeks actual, treble and punitive damages, pre- and post-judgment interest, attorneys’ fees, costs of court and such other and further relief to which she may be justly entitled.
