Tractor-trailer driver seeks damages from Everhart Transport, driver after I-30 collision

TEXARKANA – An Alabama tractor-trailer driver alleges injuries he sustained in a collision on Interstate 30 needed surgical intervention.

Robert K. Yurk filed a complaint on Jan. 12 in the Texarkana Division of the Eastern District of Texas against Everhart Transport Inc. and McKinley L. Holt alleging negligence.

According to the complaint, on Feb. 11, 2016, the plaintiff was carefully driving his 2014 International tractor-trailer when defendant Holt carelessly operated defendant ETI's 2015 Kenworth tractor-trailer and struck the back of the plaintiff's trailer on Interstate 30 in Leary-Texarkana. The plaintiff alleges he sustained serious and debilitating injuries to his neck and back that required surgical intervention as a result of the collision. 

The plaintiff holds Everhart Transport Inc. and Holt responsible because defendant Holt allegedly failed to keep proper lookout, failed to take evasive actions and failed to operate a commercial motor vehicle in a careful and prudent manner.

The plaintiff requests a trial by jury and seeks all damages in excess of the jurisdictional limits of the court, pre- and post-judgment interest, costs, attorney's fees and such other lawful and equitable relief. He is represented by Susan Montee of Montee Law Firm PC in St. Joseph, Missouri.
