MARSHALL – A former maintenance worker for a sanitation company alleges he was misclassified as exempt from overtime pay.
John Raiford, individually and on behalf of all others similarly situated, filed a complaint on Jan. 8 in the Marshall Division of the Eastern District of Texas against Thomas Hanna, doing business as Hanna's Rural Sanitation, alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff was employed by the defendant from November 2015 to June 2016 to perform maintenance on the defendant's trucks. He alleges he was misclassified as an employee exempt from overtime pay.
The plaintiff holds Hanna, doing business as Hanna's Rural Sanitation, responsible because the defendant allegedly misclassified its employees as exempt from the protections of the FLSA and failed to pay its workers for all hours of work at the rates required by the FLSA.
The plaintiff seeks unpaid wages, liquidated damages, costs of this action, pre- and post-judgment interest and such other necessary and appropriate relief. He is represented by J. Derek Braziel and Travis Gasper of Lee & Braziel LLP in Dallas.
