Nurse alleges Northeast Texas Home Health LTD failed to pay overtime wages

MARSHALL – A Canton nurse has filed a class action over allegations that she and other nurses were not paid overtime wages by their home health care employer.

Alesha R. Easley, individually and on behalf of all others similarly situated, filed a complaint on Jan. 22 in the Marshall Division of the Eastern District of Texas against Northeast Texas Home Health LTD, doing business as At Home Health, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed as a nurse by the defendant and worked between 60 to 70 hours per week.

The plaintiff holds Northeast Texas Home Health LTD responsible because the defendant allegedly made improper deductions from her salary "thereby nullifying any claimed salary exemption to overtime pay and thereby failed to pay the RN nursing staff overtime compensation as required by the FLSA," the suit states.

The plaintiff requests a trial by jury and seeks unpaid wages, liquidated damages, court costs, attorneys’ fees and such other and further relief. She is represented by William S. Hommel Jr. of Hommel Law Firm in Tyler.
