Man alleges wet floor at Pallet Logistics of America caused fall, injuries

HOUSTON – A Harris County man alleges he was injured while working because he was not provided a safe work environment.

Fernando Herrera filed a complaint on Jan. 23 in the Houston Division of the Southern District of Texas against Pallet Logistics of America LLC alleging negligence.

According to the complaint, the plaintiff alleges that on June 2, 2016, he was performing work for defendant Pallet Logistics at a distribution center in Houston when he slipped and fell due to the wet floor, causing him serious injuries. 

He alleges he has suffered and will continue to suffer medical and health care expenses, lost wages and lost earning capacity, pain and suffering, mental anguish and loss of enjoyment of life. 

The plaintiff holds Pallet Logistics of America LLC responsible because the defendant allegedly failed to provide equipment, training and supervision necessary for performance of the job and failed to properly warn him.

The plaintiff requests a trial by jury and seeks damages in an amount of more than $75,000, costs of court, prejudgment and post-judgment interest and such other and further relief, both general and special. He is represented by J. Moises Cedillos of Cedillos Law Firm PLLC in Houston.
