Two workers allege Oak Commercial Construction owes unpaid overtime wages

HOUSTON – Construction worker and a painter have filed a class-action lawsuit against a construction company over allegations they are owed unpaid wages.

Denis Doblado and Julio Ramos, individually and on behalf of all others similarly situated, filed a complaint on Jan. 23 in the Houston Division of the Southern District of Texas against Oak Commercial Construction LLC, Aaron Zappas and Neal Beakey alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs were employed by the defendants and allege they worked in excess of 40 hours per week. They allege they were paid on an hourly and/or day-rate basis.

The plaintiffs hold Oak Commercial Construction LLC, Zappas and Beakey responsible because the defendants allegedly failed to pay the required overtime premiums at the rate of one-and-one-half times their regular rate of pay for all hours worked in excess of 40 hours in a week.

The plaintiffs request a trial by jury and seek unpaid overtime wages at the applicable rate, liquidated damages, prejudgment interest, all costs and attorney’s fees, and such further relief that are just and equitable. They are represented by Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
