Consumers claim BC Services collection calls were unlawful

TEXARKANA – Two Texarkana consumers have filed a suit against a debt collector over its collection practices.

Felicia Davis and Byron Lightsey filed a complaint on Jan. 25 in the Texarkana Division of the Eastern District of Texas against BC Services alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiffs allege that on Jan. 30, 2017, Lightsey began receiving calls from defendant attempting to collect an alleged debt from defendant Davis. He alleges he told the defendant that Davis could not be reached at his number and to remove his number from the account, but the defendant called him again the next month.

The plaintiffs holds BC Services responsible because the defendant allegedly contacted Lightsey for a purpose other than to confirm or correct location information and caused his phone to ring repeatedly.

The plaintiffs request a trial by jury and seek actual, statutory and punitive damages, costs, attorney's fees and such other just and proper relief. They are represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
