Couple claims Big City Floors LLC, others never started work on home

HOUSTON – A Harris County couple alleges they paid for work on their residence that was never started.

Viet Nguyen and Ngoc Nguyen filed a complaint on Jan. 26 in the Harris County District Court against Big City Floors LLC, Chris Lynch, Michael Standridge and Bank of America NA alleging fraud, civil conspiracy, breach of contract and other counts.

According to the complaint, the plaintiffs allege that on Nov. 9 2017, they made a check deposit to defendant Lynch, the represented owner of Big City Floors, in the amount of $20,000 for construction work. The suit states Standridge later contacted them for more money and stated he was the owner of Big City Floors and that Lynch had been terminated.

The plaintiffs allege the contracted work has never commenced and the amount they paid has not been returned. They also allege on Nov. 9, 2017, Bank of America accepted their check without proper endorsement.

The plaintiffs hold Big City Floors LLC, Lynch, Standridge and Bank of America NA responsible because the defendants allegedly misrepresented their intent to perform under the contract.

The plaintiffs request a trial by jury and seek actual, consequential and incidental damages, statutory penalties, pre- and post-judgment interest, attorney's fees and all other relief as justice and equity may require. They are represented by Jerrad Bloome of Weycer, Kaplan, Pulaski & Zuber PC in Houston.
