Freelance photographer alleges Willie Nelson photo was published without attribution

HOUSTON – An Indiana freelance photographer alleges his photo of singer Willie Nelson taken in 2009 was used without his permission by a media company.

Larry G. Philpot filed a complaint on Jan. 31 in the Houston Division of the Southern District of Texas against Hearst Newspapers LLC alleging copyright infringement.

According to the complaint, the plaintiff alleges that he is the owner and creator of a photograph of Willie Nelson and that the defendant posted it on its website without attributing it to the plaintiff.

The plaintiff requests a trial by jury and seeks an order permanently enjoining defendant from directly or indirectly infringing plaintiff’s copyrighted photos, actual damages, disgorgement of all profits derived by from its act of infringement, with interest, attorney’s fees and all other and further relief. He is represented by Kenton J. Hutcherson of Hutcherson Law PLLC in Dallas.
