Ferguson Law Firm lands 63K verdict against Allstate following trial of auto collision suit

BEAUMONT – A Jefferson County jury recently levied a verdict worth more than $63,000 against Allstate Indemnity for not paying benefits to an insured that was injured in an automobile collision.

The lawsuit was brought by Evelyn King, who was injured on Jan. 15, 2015, when her vehicle was struck, without warning, by Sean Anderson. Sean Anderson was driving a vehicle owned by Mary Anderson.

King’s attorney, Cody Dishon of The Ferguson Law Firm, says his client suffered neck injures in the collision and required treatment for 6 months after the incident.   

The suit states King was covered by an Allstate policy that provided for uninsured and underinsured motorist benefits for which she was entitled to recover.

Dishon told the Record Allstate declined to offer a pretrial offer for settlement.

“Allstate said my case was worth nothing – the jury disagreed,” Dishon said. “No case will ever be too big or small for me.”

The suit was called up for trial on Jan. 29, court records show.

Jurors awarded King $30,000 for her past pain and suffering, $5,000 for her past impairment and $28,792.99 for her past medical expenses.

Judge Justin Sanderson, 60th District Court, presided over the trial.
