Man seeks damages from Tiki Island employer after fall from allegedly improperly constructed scaffolding

GALVESTON – A Galveston County man alleges his Tiki Island employer failed to provide a safe place to work.

Dan Ray Gonzalez filed a complaint on Feb. 7 in the Galveston County District Court against Jimmy Gardner alleging negligence.

According to the complaint, the plaintiff alleges that on June 10, 2016, he was injured while working in the course and scope of his employment with defendant when he fell from an improperly constructed scaffold. 

He alleges he sustained serious and permanent injuries resulting in physical and mental pain, loss of wages, disfigurement and medical expenses. 

The plaintiff holds Gardner responsible because the defendant allegedly failed to provide proper equipment and adequate assistance and failed to require and enforce the use of fall protection devices.

The plaintiff requests a trial by jury and seeks monetary damages of more than $1 million. He is represented by Eric D. Nielsen of The Nielsen Law Firm PC in Houston.
