Driver alleges Arkansas Utility Protection Services employee's distracted driving caused collision

MARSHALL – A driver is seeking damages from an Arkansas man and his employer after a rear-end collision in Nash.

James Whorton Jr. filed a complaint on Feb. 7 in the Marshall Division of the Eastern District of Texas against Arkansas Utility Protection Services Inc. and Tylor Ray Dodds alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 17, 2017, he was operating a 2014 Nissan van and was stopped at a red light facing west at the intersection of New Boston Road and North Kings Highway in Nash when he was rear-ended by a vehicle driven by Dodds, who was in the course and scope of his employment with Arkansas Utility.

The plaintiff alleges Dodds was looking at a computer screen inside the vehicle instead of at the road. He claims he sustained serious injuries to his shoulder and back. 

The plaintiff holds Arkansas Utility Protection Services Inc. and Dodds responsible because defendant Dodds failed to keep careful lookout and failed to timely and properly apply brakes.

The plaintiff requests a trial by jury and seeks actual and exemplary damages, pre- and post-judgment interest, costs of court and all other relief available. He is represented by Carson R. Runge and Brandon L. Beagley of Sloan Hatcher Perry Runge Robertson & Smith in Longview.
