Condominium owner sues over water damage to unit

GALVESTON – A local woman has filed a lawsuit in response to purported water damage to her condominium, recent Galveston County District Court records show.

Sandra Ortiz alleges a plugged sink in another unit at The Victorian caused the flooding in question on Dec. 13, 2017.

Listed as defendants in the litigation are Carol Ann Witherspoon, the president of The Victorian Condominium Association; Robert Middleton, the occupant above Ortiz’s unit; and Charna Graber Real Estate, Inc., doing business as Closing Time Properties.

The suit explains that Closing Time hired cleaning personnel which left a water valve open in Middleton’s unit. One of the cleaners supposedly plugged the sink.

Court documents fault Witherspoon for failing to properly screen the cleaning personnel prior to allowing them on the premises.

Ortiz estimates her damages to be at least $35,000.

A jury trial is requested.
