HOUSTON – A Harris County woman alleges she was injured in an accident after a rear tire fell off of her vehicle while driving.
Jennifer Atkins filed a complaint on Feb. 13 in the Harris County District Court against Discount Tire Co. of Texas Inc., Hyundai Corp. USA and Hyundai Motor America alleging violation of the Deceptive Trade Practices Act.
According to the complaint, the plaintiff alleges that on June 4, 2016, while she was driving a 2012 Hyundai Elantra Limited when suddenly its rear passenger tire detached, causing an accident. The suit states Discount Tire performed work on the vehicle two weeks prior to the accident.
She alleges she suffered injuries and property damages and was caused to suffer pain and suffering, medical expenses and reduction of earning capacity.
The plaintiff holds Discount Tire Co. of Texas Inc., Hyundai Corp. USA and Hyundai Motor America responsible because the defendant allegedly breached the implied warranty of good and workmanlike services by installing a defective and dangerous tire on her vehicle or by breaching the standard of car by negligently manufacturing her vehicle.
The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other lawful and equitable relief. She is represented by Michael E. Pierce and James P. Lamey of Pierce Skrabanek PLLC in Houston and Ryan B. Berchelmann of Stewart J. Guss Attorney at Law in Houston.
