HOUSTON – A construction worker alleges an improperly assembled scaffold caused him to trip and fall.
Alfredo Rocha filed a complaint on Feb. 15 in the Harris County District Court against Empire Scaffolding Shoring Systems Inc. and Sunbelt Rentals Scaffold Services LLC alleging negligence.
According to the complaint, the plaintiff alleges that on Feb. 16, 2016, he was an employee of S&B Engineers and Construction working at a job site in Houston when he tripped over defendants' improperly assembled and marked scaffold. He alleges he fell and suffered serious and permanent injuries resulting in pain and anguish, lost wages, physical impairment and disfigurement and medical expenses.
The plaintiff holds Empire Scaffolding Shoring Systems Inc. and Sunbelt Rentals Scaffold Services LLC responsible because the defendants allegedly failed to adequately enforce safety rules and regulations, failed to properly assemble scaffolds and failed to provide sufficient warnings of the unsafe condition.
The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million, and such other relief to which he is entitled. He is represented by Eric D. Nielsen and Pulkit Moudgil of The Nielsen Law Firm PC in Houston.
