HOUSTON – A consumer alleges a third-party debt collector continues to call him after he revoked his consent to receive calls.
Timothy Tran filed a complaint on Feb. 27 in the Houston Division of the Southern District of Texas against Convergent Outsourcing Inc. alleging violation of the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in December 2017, he began receiving calls to his cellular phone from the defendant seeking to collect an alleged debt. He alleges he has never had a business relationship with the defendant and did not give it his permission to contact him.
The plaintiff holds Convergent Outsourcing Inc. responsible because the defendant allegedly continued to call him at least 30 times after he demanded it to cease calling him on his cellular phone.
The plaintiff requests a trial by jury and seeks statutory damages of $1,000, treble damages of at least $500, actual and punitive damages, costs and attorney fees and such other just and appropriate relief.
