Account Discovery Systems alleged to have made false statement in collection call

SHERMAN – A Grayson County consumer alleges a debt collector falsely stated it issued a petition for wage garnishment.

Monika Hundley filed a complaint on Feb. 28 in the Sherman District of the Eastern District of Texas against Account Discovery Systems LLC and International Fidelity Insurance Co. alleging that they violated the Fair Debt Collection Practices Act and the Texas Finance Code.

According to the complaint, the plaintiff alleges that Account Discovery Systems left a voicemail for her Jan. 15 regarding an alleged debt. She alleges she disputes the account and that the message falsely stated a petition for wage garnishment had been issued.

The plaintiff holds Account Discovery Systems LLC and International Fidelity Insurance Co. responsible because Account Discovery Systems allegedly did not provide meaningful disclosure of its identity and never informed her of her right to dispute the alleged debt.

The plaintiff requests a trial by jury and seeks actual and statutory damages, attorney’s fees and costs and such other and further relief that is just and proper. She is represented by Jeffrey D. Wood of The Wood Firm PLLC in Little Rock, Arkansas.
