HOUSTON – An apartment complex owner alleges that it suffered damages to its property after an appliance failed and caught fire.
Northpointe Village Apartments LLC filed a complaint on March 1 in the Harris County District Court against Sears, Roebuck and Co. and Electrolux Home Products Inc. alleging negligence, strict liability and other counts.
According to the complaint, the plaintiff alleges that on Jan. 13, 2017, a fire occurred in one of the units at plaintiff's Northpointe Apartments, causing damage to its real and personal properties. The suit states an investigation done by the city of Houston Arson Bureau concluded that the fire originated from the refrigerator manufactured by defendants.
The plaintiff holds Sears, Roebuck and Co. and Electrolux Home Products Inc. responsible because the defendants allegedly failed to manufacture the refrigerator in a safe manner and distributed or sold a defective refrigerator.
The plaintiff seeks actual damages, attorney's fees, costs, pre- and post-judgment interest and such other relief to which it is entitled. It is represented by Griffin P. McDonald in Houston.
