Former Smith Protective Services employee alleges termination was related to workers' compensation claim

HOUSTON – A Harris County woman alleges she lost her job after she filed a workers' compensation claim.

Tamika Harvey filed a complaint on March 2 in the Harris County District Court against Smith Protective Services Inc. and Shriners Hospitals for Children Inc. alleging that they violated Section 451.001 of the Texas Labor Code.

According to the complaint, the plaintiff was hired by the defendants in September 2013 as a manager of the care management department. She alleges in February 2016, she was assaulted by a visitor at a Shriners facility in Houston and eventually took a leave and applied for workers' compensation because of the injuries she sustained. 

The suit states she was terminated on April 19, 2016. The plaintiff alleges her termination was a result of her filing a workers' compensation claim.

The plaintiff holds Smith Protective Services Inc. and Shriners Hospitals for Children Inc. responsible because the defendants allegedly discriminated against her and terminated her employment in retaliation for filing a workers' compensation claim.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other relief to which she is entitled. She is represented by N. Lucy Nkechinyelumka Chukwurah of N. Lucy Chukwurah Law Group PC in Houston.
