Protect Controls alleged to have failed to pay overtime to former salesperson

HOUSTON – A Conroe woman alleges she was not paid overtime wages while employed as a salesperson for a construction company.

Diana Braud filed a complaint on March 6 in the Houston Division of the Southern District of Texas against Protect Controls Inc. and Walter Davis alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Sept. 19, 2002, and Dec. 6, 2016, she regularly worked for the defendants for more than 40 hours per week without receiving proper overtime compensation. 

The plaintiff holds Protect Controls Inc. and Davis responsible because the defendants allegedly failed to act reasonably to comply with the overtime provisions of the FLSA.

The plaintiff requests a trial by jury and seeks unpaid wages, liquidated damages, pre- and post-judgment interest, attorney’s fee, costs and such other relief that is proper and equitable. She is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
