Former Fred’s employees allege they were not paid for all hours worked

MARSHALL – Former employees for a discount general merchandise and pharmacy store chain have filed a class-action lawsuit over allegations they are owed unpaid wages.

Abel Eddington and Judy Hudson, individually and on behalf of all others similarly situated, filed a complaint on March 8 in the Marshall Division of the Eastern District of Texas against Fred’s Inc. and/or Fred’s Stores of Tennessee Inc. alleging that the joint employers violated the Fair Labor Standards Act and the Kentucky Wage and Hour Act.

According to the complaint, the plaintiffs allege that they were not paid for all hours worked during their employment with the defendant.

The plaintiffs hold Fred’s Inc. and/or Fred’s Stores of Tennessee Inc. responsible because the defendant allegedly improperly required them to clock out for rest breaks lasting 20 minutes or less and automatically deducted 30-minute meal periods from their time records despite knowing that they routinely worked throughout their designated breaks. They allege they were not paid at a rate of time-and-one-half of their regular rate of pay for hours worked beyond 40 per week.

The plaintiffs request a trial by jury and seek to recover unpaid wages, pre- and post-judgment interest, attorneys’ fees, costs, expense and such other and further relief that are proper and just.
