Med-mal trial over use of da Vinci Surgical System starts in Beaumont

BEAUMONT – The trial of a medical malpractice lawsuit over the use of the da Vinci Surgical System, a robotic device used to assist surgeons, has begun.

Reagan Corbello filed suit against Southeast Texas OB/GYN Associates and Dr. Ruben Victores on Sept. 10, 2015 in Jefferson County District Court.

The case was called up for trial on March 19.

According to the lawsuit, on Sept. 18, 2013, two years prior to filing the lawsuit, Corbello was scheduled for a hysterectomy. Victores used the da Vinci Surgical System, even though Corbello presented with risk factors that the system specifically warns against.

Court records show Corbello had previously undergone obesity surgery and weighed 300 pounds at the time of her visit to Victores.

She faults the defendants for failing to select the most appropriate surgical procedure.

Corbello will ask jurors to award her damages for her past mental anguish, impairment, medical expenses and lost wages.

She is represented by Adam Terrell, attorney for the Beaumont law firm Weller Green Toups & Terrell.

Judge Kent Walston, 58th District Court, is presiding over the case.
