Whataburger fired employee because she has epilepsy, lawsuit says

HOUSTON – Whataburger is accused of firing a worker who reportedly suffers from epilepsy.

The terminated employee, Maggie Fordyce, brought a lawsuit against the fast food eatery on Mar. 16 in the Harris County 165th District Court.

Fordyce worked for the defendant from 2014 to earlier this year.

She claims the restaurant kept her on unpaid FMLA leave in early 2016 as a way for her to use up all of her protection and then terminate her employment without legal consequences.

The respondent reportedly refused to honor an accommodation request from Fordyce’s doctor, “but seemed intent on firing her,” as well as prevented her from assuming the position of team leader.

Consequently, Fordyce seeks unspecified monetary damages and a jury trial.
