HOUSTON – A Fourth of July workout for a Harris County man two years ago reportedly ended in injury.
Ryan Firth’s lawsuit against Equinox Fitness River Oaks, Inc. says a defective piece of exercise equipment at the defendant’s gym harmed the plaintiff.
According to court papers filed on Mar. 19 in the Harris County 333rd District Court, Firth was using a hyperextension machine when the bottom half of the machine collapsed on Firth.
The plaintiff reportedly hit his neck against the machine and suffered a “bruised and torn” trachea.
“The hyperextension machine was missing a pin meant to support the bottom half,” the suit says.
Firth faults the gym for not properly inspecting the machine nor training its employees.
Consequently, he seeks unspecified monetary damages and a jury trial.
Loren G. Klitsas and Jared W. Capps of the law firm Klitsas & Vercher, P.C. in Houston are representing the complainant.
