Former Ruiz Food Products tortilla thrower alleges gender was a factor in discharge

SHERMAN – A Grayson County woman alleges she was terminated from her employment at a Denison location because of weight restrictions.

Ilean Stapleton filed a complaint on March 19 in the Sherman District of the Eastern District of Texas against Ruiz Food Products Inc. alleging that the former employer violated the Americans with Disabilities Act and other counts.

According to the complaint, the plaintiff was employed as a tortilla thrower by the defendant and began her employment in May 2016. In March 2017, she alleges she was asked to work in packaging as an extra, which required lifting she was concerned would exacerbate her current back pain. The suit states she was put under lifting restrictions by her doctor the same month and was terminated because of the restrictions March 30, 2017.

The plaintiff alleges she was discharged because of her gender and discriminated against because of her perceived disability.

The plaintiff requests a trial by jury and seeks actual damages within the jurisdictional limits of the court with interest, reinstatement, attorney’s fees, costs and all lawful and equitable relief. She is represented by Ronald R. Huff in Sherman.
