Houston seeks damages from man over collision with police officer

HOUSTON – The city of Houston has filed suit against a man who allegedly drove impaired and struck a police officer's vehicle.

The city of Houston filed a complaint on March 26 in the Harris County District Court against Robert Lott Zimmerman alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 27, 2017, Zimmerman was driving under the influence of drugs and failed to yield to the right of way of an emergency vehicle driven by Houston Police Officer Nestor Daniel Garcia, striking Garcia's vehicle. The plaintiff alleges it paid workers' compensation benefits to Garcia as a result of the collision.

The plaintiff holds Zimmerman responsible because the defendant allegedly failed to keep a proper lookout, failed to stop and failed to take evasive actions to avoid impacting an emergency vehicle and drove a vehicle under the influence of drugs.

The plaintiff seeks actual damages, pre- and post-judgment interest and such other legal and equitable relief. He is represented by Dean G. Pappas and Mary M. Markantonis of Dean G. Pappas Law Firm PLLC in Houston.
