Female heavy equipment operator alleges Triple P.G. Sand Development paid her less than male counterparts

HOUSTON – A Cleveland, Texas resident alleges her Porter employer failed to pay her at the same rate as her male counterparts.

Karri Barrow filed a complaint on March 27 in the Houston Division of the Southern District of Texas against Triple P.G. Sand Development LLC alleging that the gravel and sand company violated the Fair Labor Standards Act and the Equal Pay Act.

According to the complaint, the plaintiff alleges that she regularly worked more than 40 hours per workweek for the defendant as a heavy equipment operator. She alleges she was paid less than her male co-workers and that she was terminated for refusing to take a type of drug test that was not offered to male co-workers. She alleges she "successfully" took the same drug test given to male co-workers.

The plaintiff holds Triple P.G. Sand Development LLC responsible because the defendant allegedly failed to pay all of her wages and overtime compensation for hours worked in excess of 40 per week, failed to compensate her at the rate equal to her male counterparts and fired her shortly after her participating in a protected activity.

The plaintiff requests a trial by jury and seeks unpaid wages and overtime compensation, liquidated damages, attorneys’ fees, courts costs, post-judgment interest and such other lawful and equitable relief.
