HOUSTON – A Harris County woman alleges a health care facility's negligence left her husband in a vegetative state.
Latanya Brown, individually and as next friend of Arthur Berger, filed a complaint on March 29 in the Harris County District Court against Methodist Health Centers, Houston Methodist Willowbrook Hospital, et al. alleging medical negligence.
According to the complaint, the plaintiff alleges that Arthur Berger underwent a C3-6 anterior cervical discectomy performed by defendants. After the surgery, the suit states Berger experienced a choking sensation, later became unresponsive and suffered severe brain injury that left him in a persistent vegetative state allegedly because an airway was established too late by the defendants.
The plaintiff holds Methodist Health Centers, Houston Methodist Willowbrook Hospital, et al. responsible because the defendants allegedly failed to properly monitor and assess Berger's condition, failed to timely transfer him to the intensive care unit and failed to have necessary equipment readily available.
The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other legal and equitable relief. She is represented by John J. Brothers of Brown & Brothers in Houston.
