McDonald's accused of infringing on mobile device patents

Patents 04

TYLER – A fast food giant is accused in a federal lawsuit of infringing on a batch of patents pertaining to mobile device technology.

In recent court papers filed on Mar. 24 in the Tyler Division of the Eastern District of Texas, Aeritas, LLC asserts McDonald’s illegally used patent numbers 8,055,285; 9,390,435; and 9,888,107 for its Apple and Android application.

Aeritas claims ownership of the subject patents, which are entitled “Mixed-Mode Interaction.”

Court documents show that Malik Mamdani, Patrick Johnson, Kevin Bomar, Curtis Grant, and Tim Whatley invented the patents.

The patents in question enable users of the restaurant’s app to place orders and receive notifications, as well as ask and answer questions.

“Aeritas has been damaged by McDonald’s infringing activities and will be irreparably harmed,” the complaint states.

Consequently, the plaintiff seeks unspecified monetary damages and a jury trial.

It is represented by Matthew DelGiorno of the law firm DelGiorno IP Law, PLLC in Allen.
